General Terms and Conditions of Sale
Article 1: Application of these general conditions of sale
In the absence of specific stipulations agreed in writing between the parties, all orders are automatically subject to these general terms and conditions of sale, which prevail over any other document, such as prospectuses, press, catalogues or e-mailings issued by the seller, which are only indicative. The fact that the seller does not take advantage at a given time of any of the provisions of these terms and conditions shall not be interpreted as a waiver of the right to take advantage at a later date of any of the said conditions. All our offers of deliverable wines are subject to availability. Orders sent to our company are irrevocable for the customer, 8 days after receipt by the company of the initial order. Any request to modify an order placed must be made in writing. In the event of acceptance of the modification of the order, our company shall be released from the deadlines agreed for its execution. In the event that a customer places an order with the company without having paid for his previous order(s), we may refuse to honour the order without the customer being able to claim any compensation.Article 2: Order and payment terms
Our Internet offers are exclusively reserved for private customers in metropolitan France, and in no case for professional resellers. Orders are confirmed by the sending of the invoice but are only definitive on receipt of full payment of the price of the goods. The payment of the goods is made in full at the time of order by credit card such as Carte Bleue, Visa, Eurocard Mastercard… or, in the case of sales to professionals, by bill of exchange accepted by the company. No postponement of the due date can be granted without our prior express consent. For deliveries abroad, please contact us.Article 3: The prizes
The prices are expressed in Euros, including all taxes (applicable VAT, excise and any other applicable taxes). The prices indicated on the mail order documents are quoted exclusive of shipping costs. Shipping costs are invoiced according to the total amount of the order and the place of delivery in metropolitan France. Domaine Houblin-Vernin reserves the right to modify its sales prices at any time.Article 4: Delivery and acceptance
The goods are insured by us during their transport in metropolitan France and travel at our own risk. Deliveries are made in multiples of 6 bottles and a maximum of 36 bottles (beyond 36, please contact us). The Domaine Houblin-Vernin accepts the order and launches the delivery operations, upon receipt of payment. The delivery of the ordered articles is carried out at the customer’s home or at any address that he indicates at the time of his order, provided that it is located in Metropolitan France. The information given by the customer when placing the order is binding on the customer: in the event of an error in the recipient’s details, Domaine Houblin-Vernin cannot be held responsible for the impossibility of delivering the product. The orders are deliverable in one time at the same place. Our deliveries are made within an average of 10 days from the date of payment of the order to Domaine Houblin-Vernin in France. This delivery time is only given as an indication and any delay in delivery cannot justify the cancellation of the order, nor any penalty or indemnity, except with our agreement. However, if one month after written complaint by the customer, the goods have still not been delivered, the sale may be cancelled at the initiative of either party. The customer shall obtain restitution of his payment to the exclusion of any other compensation or damages, at the latest within one month. In any case, delivery within the time limit can only take place if the customer has given the seller exact information about the recipient’s details. In case of error, the Domaine Houblin-Vernin cannot be held responsible for the impossibility of delivering the goods at the right place and time. On receipt of the goods, it is the responsibility of the recipient to check the condition of the goods and to make all necessary observations in the event of breakage, damage or missing items, by expressing his reservations on the delivery note, and within 48 hours of receipt of the goods, by registered letter with acknowledgement of receipt to the carrier, with a copy to the seller, in order to preserve his rights.Article 5: Right of withdrawal
In application of the provisions of article L.121-16 of the Consumer Code, the customer has a period of seven (7) clear days from the delivery of his order to return the unwanted products to the seller in their original packaging, for exchange or reimbursement, without penalty, with the exception of the return costs. In the event that certain products have been opened or consumed, these products will be deducted from the refund made to the customer. The return costs are at the customer’s expense. The customer must in all cases inform the sales department in writing (e-mail, fax, letter) of his decision before returning the goods. decision before returning the goods by registered letter with acknowledgement of receipt. As an exception, these provisions do not apply to orders for products that have been customised or specifically requested by the customer when ordering (special formats, customised packaging, etc.). In case of exercise of the right of withdrawal by the customer on the exchanged product, the return costs will be charged to the Domaine Houblin-Vernin.Article 6: Termination of the contract
In the event of non-payment by the customer on the agreed due date and one month after a formal notice has remained unsuccessful, the sale shall be cancelled by operation of law if the seller sees fit, with restitution of the deposits paid by the purchaser, and the possibility for the seller to request, in summary proceedings, the restitution of the products already delivered, if applicable, without prejudice to other damages and interest.Article 7: Applicable law and competent jurisdiction
The present general conditions of sale are subject to the application of French law, excluding the provisions of the Vienna Convention. For sales between professionals, the courts of the Domaine Houblin-Vernin’s registered office shall have sole jurisdiction for any dispute arising from the application of these terms and conditions. With regard to sales between private individuals, the directives and regulations of the European Union, in particular the Brussels Convention, shall apply.Article 8: Legal information
By virtue of order no. 59-107 of 7 January 1959, which stipulates the prohibition of the sale of alcohol to minors under sixteen years of age, law no. 74-631 of 5 July 1974, the customer undertakes, by filling in the order form, to be at least eighteen (18) years old at the date of the order. Alcohol abuse is dangerous for your health. Know how to consume and appreciate it in moderation. Data Protection Act: Pursuant to Article 27 of Law No. 78-17 of 6 January 1978, personal data provided by the customer may give rise to the exercise of the right of access and rectification with the Domaine Houblin-Vernin. In order to meet the needs of our customers and to ensure an optimal remote service, we have to record certain personal data (name, first name, address). This information is intended exclusively for Domaine Houblin-Vernin. In accordance with the provisions of Law No. 98-536 of 1 July 1998, transposing Directive 96/9/EC of 11 March 1996 on the legal protection of databases, Domaine Houblin-Vernin is the owner of all or part of the databases making up this site.
